This Agreement governs your use of the DriverZpoint platform (“Platform”), which includes our website and mobile application. By accessing or using our services, you agree to be bound by these Terms & Conditions, our Privacy Policy, and the Cancellation Policy. If you do not agree with any part of this Agreement, please do not use our services.
Definitions:
DriverZpoint, we, our, or us refers to the operator of this Platform.
User, you, or your means any individual or entity using our services.
Partner refers to the service provider (formerly “companion”) who provides the driving services through our Platform.
Platform refers to the DriverZpoint website and mobile application.
Service refers to the short-term private driving or vehicle service arranged via our Platform.
Service Description:
DriverZpoint provides a technology-driven service that connects Users with Partners for short-term private driving solutions within designated areas. Our Platform facilitates the booking, tracking, and management of these services but does not itself provide transportation.
Use of the Platform:
Service Request: Users may request services via the Platform, which uses geo-location (with your permission) to match you with an available Partner.
Acceptance: We reserve the right to accept or reject any service request at our sole discretion.
Permitted Use: The Platform is provided solely for personal or internal use. Unauthorized or commercial use is prohibited.
Registration and Account Security:
Account Setup: To access our services, you must register by providing accurate and complete personal information (e.g., name, contact details).
Security: You are responsible for safeguarding your account credentials. Any activity under your account is your responsibility.
Account Suspension: We reserve the right to suspend or terminate any account that violates these Terms or poses a risk to the integrity of our Platform.
Representations and Warranties:
You represent that all information provided is accurate and that you are legally entitled to use the services.
You acknowledge that it is your duty to verify the Partner’s credentials (e.g., driver’s license) before the service begins.
The service is provided on an “as is” basis without any express or implied warranty regarding uninterrupted, secure, or error-free operation.
Payment and Charges:
Fare: You agree to pay the fare displayed in the DriverZpoint App, which may include additional fees (such as tolls, surcharges, or cancellation fees).
Payment Processing: Payment is handled through secure third-party processors. You must ensure that the payment details provided are current and accurate.
Refunds and Cancellations: Cancellation policies and any related charges will be as outlined in our cancellation guidelines.
Intellectual Property Rights:
All content on the Platform—including text, images, software, and graphics—is owned or licensed by DriverZpoint.
You are granted a limited, non-transferable license to access and use the content solely for personal purposes. Unauthorized copying, modification, or distribution is prohibited.
Prohibited Uses:
You agree not to:
Access or attempt to access data or areas of the Platform not intended for you.
Employ automated tools to copy or extract content.
Interfere with the security or operation of the Platform (e.g., by hacking, overloading, or transmitting viruses).
Reverse engineer, decompile, or disassemble any part of the Platform.
Use the Platform for sending unsolicited communications or for any unlawful purposes.
Limitations of Liability and Disclaimers:
The services are provided “as is” without warranties of any kind.
DriverZpoint shall not be liable for any direct, indirect, incidental, or consequential damages arising from your use of the Platform or the services provided.
Our maximum liability in any event will not exceed the fees paid for the service.
Force Majeure:
DriverZpoint is not responsible for delays or failures in performance due to causes beyond our reasonable control (e.g., natural disasters, war, or governmental actions).
Complaints and Dispute Resolution:
Complaints: Users must report any service-related issues within 24 hours. We will investigate and may take corrective action, including suspending a Partner or account if necessary.
Dispute Resolution: Any disputes arising under these Terms will be governed by the laws of Kolkata High Court and subject to the exclusive jurisdiction of the courts located in Kolkata.
Miscellaneous:
Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and DriverZpoint.
Modifications: We may update these Terms from time to time by posting a revised version on our Platform. Continued use of the services constitutes acceptance of the updated Terms.
