This Agreement governs your participation as a Partner (Driver) on the DriverZpoint platform (“Platform”), which includes our website and mobile application. By registering as a Partner and using our services, you agree to be bound by these Terms & Conditions, Privacy Policy, and Cancellation Policy. If you do not agree with any part of this Agreement, please do not register as or continue operating as a Partner on our Platform.
Terms & Conditions for Partners
Definitions:
DriverZpoint, we, our, or us refers to the operator of the Platform.
Partner refers to you—the registered driver who provides short-term private driving services via our Platform.
Platform means the DriverZpoint website and mobile application.
Service means the driving services you provide when a customer (User) books through our Platform.
Cancellation Fee refers to the fee imposed if a Partner cancels a confirmed service after acceptance or during the waiting period.
Service Description and Partner Obligations:
Service Role: As a Partner, you agree to provide safe, reliable, and timely driving services to Users who book through our Platform.
Verification: You must provide valid documentation (e.g., driver’s license, Aadhar ID, Bank Passbook) and remain in compliance with all applicable laws and industry standards.
Professional Conduct: You are expected to maintain a professional appearance and demeanor. Failure to adhere to the prescribed dress code or behavior guidelines may result in penalties, including suspension.
Registration and Account Security:
Enrollment: To become a Partner, you must complete the registration process by supplying accurate personal and vehicle information.
Account Security: You are solely responsible for maintaining the confidentiality of your account credentials. Any activity on your account is your responsibility.
Suspension and Termination: We reserve the right to suspend or terminate your Partner status if you violate these Terms, provide false information, or engage in misconduct.
Representations and Warranties:
You represent and warrant that you have the legal right and all necessary licenses to operate as a driver.
You agree to abide by all local traffic laws, safety regulations, and any guidelines issued by DriverZpoint.
You acknowledge that you are responsible for verifying the identity and eligibility of Users and that DriverZpoint is not liable for any disputes arising from such interactions.
Payment and Commission:
Service Fees and Commission: You will receive payment for completed services, subject to the fees and commission structure outlined in your Partner agreement. Payments are processed through secure third-party payment providers.
Accuracy of Payment Information: It is your responsibility to provide current and accurate bank or payment details. Any discrepancies may delay payment processing.
Prohibited Activities:
As a Partner, you agree not to:
Use the Platform to engage in fraudulent or illegal activities.
Access or attempt to access areas of the Platform not intended for your use.
Reverse engineer, decompile, or otherwise attempt to obtain the source code of the Platform.
Engage in any behavior that undermines the trust of Users or disrupts the operations of DriverZpoint.
Limitations of Liability and Disclaimers:
Service “As Is”: The Platform and any associated services are provided on an “as is” basis without any warranties, express or implied.
Liability Cap: DriverZpoint’s liability for any claims shall be limited to the fees paid to you for the affected service.
No Guarantee of Service Continuity: We do not guarantee uninterrupted service or error-free operation of the Platform.
Force Majeure:
DriverZpoint shall not be held liable for any failure or delay in performance due to causes beyond our reasonable control (including natural disasters, acts of government, or other events considered force majeure).
Dispute Resolution:
Internal Resolution: Any complaints or disputes should first be reported to DriverZpoint’s support team for resolution.
Governing Law: This Agreement is governed by the laws of Calcutta High Court. Any disputes will be subject to the exclusive jurisdiction of the courts located in Kolkata.
Miscellaneous:
Entire Agreement: These Terms, together with the Privacy Policy and Cancellation Policy, constitute the entire agreement between you and DriverZpoint.
Modifications: We may update these Terms from time to time by posting a revised version on the Platform. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
